Yessle Terms of Service

Welcome to Yessle, a social media platform operated by Yessle B.V., a company registered in the Netherlands. These Terms of Service ("Terms") govern your use of Yessle.com, our mobile applications, and any related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About Yessle
At Yessle, we foster a positive, authentic, and inclusive community. You may share your own original content, including written text, photos, and videos, or share links to external websites. We encourage you to create, connect, and have fun while maintaining a respectful environment.
2. Eligibility
To use Yessle, you must:
- Be at least 13 years old. If you are under 18, you must have parental or guardian consent to use the Platform.
- Provide a valid email address for account creation and recovery.
- Not be prohibited from using the Platform under applicable laws or these Terms.
3. Account Creation and Management
- Sign-Up: You need a valid email address to create an account. Your email will be used for account creation, recovery, and, if you opt in, to send notifications. You can manage notification preferences or opt out at any time via your account settings.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@yessle.com if you suspect unauthorized use.
- Account Deletion: You may delete your account at any time through the Platform’s settings. Upon deletion, all your data, including posts, comments, and profile information, will be permanently removed after email confirmation. Note that some data may remain in our backups for a limited period as required by law.
4. Content and Sharing
- Your Content: You may share original text, photos, videos, or links on the Platform. You retain ownership of your content but grant Yessle a non-exclusive, royalty-free, worldwide license to host, display, and distribute your content on the Platform as necessary to provide our services.
- Visibility Settings: You can choose whether your posts are visible to everyone, only your friends, or privately to you. Profile pictures follow the same visibility options. You may edit or delete posts at any time.
- Content Guidelines:
- Originality: Only upload content you own or have permission to use. Do not upload content that infringes on copyrights, trademarks, or other intellectual property rights.
- Consent: For photos or videos featuring others, ensure you have their consent to share, where reasonably possible.
- Prohibited Content: Do not share:
- Content containing nudity, pornography, or sexually explicit material.
- Content that is harassing, abusive, defamatory, or discriminatory.
- Links to harmful websites, including those promoting pornography, violence, or illegal activities.
- Content that violates applicable laws or these Terms.
- Content Moderation: We reserve the right to review, remove, or restrict content that violates these Terms or is otherwise objectionable, at our sole discretion.
5. Community Standards
We strive to maintain a positive and respectful community. You agree to:
- Use respectful language and avoid harsh, insulting, or offensive remarks.
- Refrain from harassing, bullying, or discriminating against others based on race, gender, religion, nationality, or any other characteristic.
- Contribute to a welcoming and inclusive environment.
Violations of these standards may result in a warning, temporary suspension, or termination of your account, depending on the severity and frequency of the violation.
6. Privacy and Data
- Data Usage: Your email and other personal data provided to Yessle are used solely for account management, notifications (if opted in), and Platform functionality. We do not share your personal data with third parties except as required by law or to protect our rights.
- Data Storage: Content you upload is stored securely on our servers in the Netherlands and is not shared with third parties. Public or friends-only content is visible to others as per your visibility settings.

- Cookies: The Platform uses cookies to enhance your experience. By using Yessle, you consent to our use of cookies as described in our Privacy Policy.
7. Intellectual Property
- Your Rights: You retain all rights to the content you create and share on Yessle, subject to the license granted to us for Platform operations.
- Yessle’s Rights: All Platform content, including logos, designs, and software, is owned by or licensed to Yessle B.V. and is protected by copyright, trademark, and other laws. You may not use our intellectual property without prior written permission.
- Infringement Claims: If you believe your intellectual property rights have been violated, please contact us at legal@yessle.com. We comply with applicable laws, including the EU Digital Services Act, for handling infringement claims.
8. Termination
- By You: You may stop using the Platform or delete your account at any time.
- By Yessle: We may suspend or terminate your account if you:
- Violate these Terms or our Community Standards.
- Engage in illegal or harmful activities.
- Pose a risk to the Platform or other users.
Upon termination, your access to the Platform will cease, and your data will be deleted in accordance with our data retention policies.
9. Limitation of Liability
To the fullest extent permitted by law:
- Yessle B.V. provides the Platform "as is" and does not guarantee uninterrupted or error-free service.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including loss of data or profits.
- Our liability for direct damages is limited to the amount paid by you for using the Platform, if any.
10. Indemnification
You agree to indemnify and hold Yessle B.V., its affiliates, and employees harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms.
11. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of the Netherlands, excluding its conflict of law provisions.
- Disputes: Any disputes arising from these Terms or your use of the Platform will be resolved through negotiation. If negotiation fails, disputes will be submitted to the competent courts in Amsterdam, Netherlands, unless otherwise required by law (e.g., consumer protection laws in your jurisdiction).
- Consumer Rights: If you are a consumer in the EU, you may have additional rights under EU law, including the option to resolve disputes via an Alternative Dispute Resolution (ADR) mechanism or the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr).
12. Changes to These Terms
We may update these Terms to reflect changes in our services or legal requirements. We will notify you of significant changes via email or through the Platform at least 30 days before they take effect. Your continued use of the Platform after the updated Terms are effective constitutes your acceptance of the changes.

14. Miscellaneous

- No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor in the event of a merger, acquisition, or sale of assets.
